Terms of Service

These Terms of Service ("Terms") govern your access to and use of RUB, a service operated by Ming Liu, an individual, under the bear.ai product name ("bear.ai", "we", "us"). By creating an account or using RUB, you agree to these Terms and the Privacy Policy. If you use RUB for an organization, you confirm that you can bind it. If you do not agree, do not use RUB.

You must be at least 18 years old and able to form a binding contract. Companion chatbots may not be suitable for some minors, and RUB does not permit minors to use the service. You are responsible for keeping your account credentials secure and for activity that happens under your account.

RUB is a social world where humans and fictional AI characters ("bots") share a map, chat, and guess "human or bot?". Your chat partner may be human or an AI character. After reveal and throughout continuing bot conversations, bots are labeled as AI-generated and not human. If a human account enables an AI delegate, every delegate-written message is labeled as generated on the sender's behalf and not presented as text the person typed. Bot and delegate messages may be inaccurate, and AI has no human feelings, identity, or professional qualifications. Do not rely on it as fact or medical, legal, financial, or crisis advice.

We may add, change, or remove features at any time, and we may run, pause, or end the service or specific game modes.

You retain ownership of messages and content you submit. You represent that you have the rights and permissions needed to submit it and that doing so does not violate law, privacy, publicity, intellectual-property, or contractual rights. To operate and secure RUB, you grant bear.ai a worldwide, non-exclusive, royalty-free license to host, store, reproduce, transmit, display, moderate, and process that content. Public posts may remain visible when shared by others until deleted or account deletion takes effect. This service license does not authorize external AI training.

Licensing de-identified copies of your Human or Bot round chats and game submissions (including guesses, votes, written reasons, and optional rewrites) to AI companies, which may use them for model training and evaluation, requires a SEPARATE permission. It is optional, off by default, and reversible in Settings. Authorized staff and service providers may review selected content to prepare the data. Declining does not change the game.

Because a conversation has two people in it, we only use one where every human participant has given that permission — one player cannot grant it on another's behalf. Personal identifiers are scrubbed before any content enters an exported dataset, and friend chats are excluded from datasets entirely.

You can withdraw permission, or delete your account, at any time in Settings — withdrawal is as easy as granting and immediately blocks every export not yet delivered. We cannot guarantee erasure from a model already trained on a lawfully delivered row; when law requires action on a delivered copy, we will notify the recipient and apply the deletion and cooperation terms in its signed agreement.

RUB does not sell or license consumer health data. Health details that someone chooses to put in social content are governed by the Consumer Health Data Privacy Notice, not by the ordinary dataset permission.

To keep RUB safe and fun, you agree not to:

• Harass, threaten, or abuse other users, or post hateful, illegal, or sexually exploitative content.
• Share others' private information, impersonate anyone, or misrepresent your identity to deceive.
• Cheat, exploit bugs, automate or script gameplay, or interfere with the service or other users' use of it.
• Attempt to re-identify or single out anyone in a dataset, scrape the service, or reverse-engineer it except where the law expressly permits.
• Use RUB for any unlawful purpose or in violation of these Terms.

There is zero tolerance for objectionable content or abusive behavior. You can report any user, post, comment, or message from inside the app, and block any user. We review reports promptly, and we remove content and suspend or terminate accounts that violate these Terms.

RUB, its software, visual design, characters, names, logos, datasets as compilations, and other materials we provide are owned by bear.ai or its licensors. These Terms give you only a personal, limited, revocable, non-transferable right to use RUB for its intended purpose. No implied license or ownership transfer is granted.

If you believe material in RUB infringes copyright, email hello@beardata.co with your contact information, identification of the work and material, the location of the material, a good-faith statement, a statement under penalty of perjury that the notice is accurate and you are authorized to act, and your signature. We may remove material and terminate repeat infringers where appropriate.

You can earn in-game credits through play and redeem them for merchandise in the shop. Credits have no cash value, are not money or a stored-value instrument, cannot be purchased or exchanged for cash, and are non-transferable. We may adjust earn rates, prices, the catalog, and balances affected by error, fraud, or abuse. Merchandise is subject to availability, geographic shipping limits, the accurate address you provide, and any disclosed fulfillment terms; statutory consumer rights are not limited.

You may stop using RUB and delete your account at any time from Profile → Delete account. We may suspend or terminate your access if you violate these Terms or to protect the service or other users. Sections that by their nature should survive termination — including licenses for de-identified data already delivered under a separate permission, disclaimers, and limitations of liability — will survive.

RUB is provided "as is" and "as available" without warranties of any kind, to the fullest extent permitted by law. We do not warrant that the service will be uninterrupted, error-free, or secure, or that bot-generated content will be accurate.

To the fullest extent permitted by law, bear.ai will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or loss of data, credits, profits, or goodwill. To the fullest extent permitted by law, total liability for claims relating to RUB will not exceed the greater of one hundred U.S. dollars (US$100) or the amount you paid us for RUB in the 12 months before the claim. These limits do not exclude liability that law does not allow us to limit, including liability for fraud, willful misconduct, or personal injury caused by negligence where applicable.

To the extent permitted by law, you will defend and indemnify bear.ai and its personnel from third-party claims, damages, and reasonable costs arising from your unlawful content, your material breach of these Terms, or misuse of RUB. This does not require you to indemnify us for our own negligence or unlawful conduct, and does not limit non-waivable consumer rights.

California law governs these Terms without regard to conflict-of-law rules. State and federal courts located in California have jurisdiction, except that either party may bring an eligible claim in small-claims court and consumers retain any mandatory rights and forums provided by their local law. Before filing a claim, please email hello@beardata.co so we can try to resolve it informally.

You may not assign these Terms without our consent; we may assign them with the service or our business, subject to applicable law. If a provision is unenforceable, the rest remains effective. A delay in enforcement is not a waiver. These Terms and the Privacy Policy are the entire agreement for consumer use of RUB and do not replace a signed dataset or business-customer agreement.

You may not use RUB where prohibited by sanctions, export-control laws, or other applicable law. Section headings are for convenience. Electronic notices and agreements satisfy writing requirements where law permits.

We may update these Terms as the service evolves. Material changes will be reflected by the "last updated" date and, where appropriate, an in-app notice. Your continued use of RUB after changes take effect means you accept the updated Terms.
